Lil Durk’s lawyers oppose using his song ‘Pissed Me Off’ as evidence in his upcoming murder-for-hire trial, citing procedural errors by prosecutors.
Lil Durk’s legal team has taken a strong stand against a move by federal prosecutors to admit the rapper’s 2022 song and video for “Pissed Me Off” as evidence in his impending murder-for-hire trial. Prosecutors argued that the song and its accompanying video illustrate Durk’s readiness to seek violent revenge following the death of his friend and OTF label mate, King Von.
In a motion filed on August 7, Durk’s attorneys contended that the use of the video should be dismissed due to significant errors made by the prosecution. They referenced a court order dated February 13, which specified that all music videos must be excluded from trial unless they fulfill specific criteria. According to the order, a video could only be included if it shows that a particular person’s appearance was part of any reward they received from Durk related to the shooting, or if it illustrates the relationship between one of Durk’s co-defendants and other alleged co-conspirators. The defense argues that the “Pissed Me Off” video does not satisfy either requirement.
Furthermore, Durk’s lawyers accused the prosecutors of relying on assumptions rather than actual investigative methods to substantiate their claims. They further asserted that the prosecution misinterprets the content of the song, arguing that it predominantly revolves around the tragic death of Durk’s brother, who was killed outside a Chicago club in 2021, rather than being solely about King Von.
The defense pointed out inaccuracies in the prosecution’s claims, including the assertion that a lookalike of King Von was utilized in the video. According to Durk’s legal representatives, the director used pre-existing footage of Von, effectively contradicting the prosecution’s arguments. “An easily dispelled inaccuracy such as this one just goes to show the uninformed flippancy in which the government views this evidence,” the defense stated.
Durk faces serious allegations of orchestrating a hit on rapper Quando Rondo, which inadvertently resulted in the death of his cousin as part of an act of retaliation for Von’s murder. As the trial is set to commence on August 20, the decision regarding the admissibility of the “Pissed Me Off” video, along with other pre-trial matters, is expected to be addressed during a hearing scheduled for August 13.
In addition to contesting the video evidence, prosecutors are also seeking to prevent Durk from utilizing rap music scholars as expert witnesses during the trial. The latest indictment against Durk has been characterized by his legal team as a “pathetic pivot” that centers around long-standing allegations.
